Types of Information We Collect
Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access our Site(s), but if you do not want to disclose certain personal information to us, you will not be able to access certain aspects of the Emily Labs.
We collect personal information when you create an account through the Emily Labs; subscribe to our newsletter; utilize voice communication tools made available through the Emily Labs; participate in chat rooms, forums, polls, surveys, and questionnaires; participate in contests, sweepstakes, other promotions, or opt into third party offers and/or newsletters; purchase a product through the Emily Labs; register a product that you have purchased; or receive customer or technical support.
To create an account for the Emily Labs, we require you to provide your name, email address and country in which you reside. You will also need to create a screen name. When you are purchasing premium services or products through the Emily Labs you may have to submit personal information to our billing partner, PayPal, including your email address, billing address and additional billing information depending on your preferred method of payment through PayPal, such as your credit card number. When you enter a contest or sweepstakes with Emily, in addition to your screen name, name and email address, we will ask for your mailing address in case we have to mail you a prize, and may ask you to opt into receiving a third party’s offers and/or newsletter.
Additionally, we may also collect other types of information (known as demographic information) such as your gender, hobbies, occupation, platform preferences, and other game ownership information. This demographic information may be associated with your personal information.
We also offer features that allow you to link your account to third party social networking sites through the Emily Labs, such as Facebook. If you sign up for one of these services, we may also collect personally information from these Internet sources and database services.
By submitting personal information through the Emily Labs, you authorize Emily to share this personal information for the purposes identified herein and as described in the Emily Labs, such as responding to user inquiries and processing transactions.
How We Use Your Personal Information
The personal information you provide to us will allow us to fulfill your product or service order; alert you of new products or services, features, or enhancements; handle/route your customer service questions or issues; and/or notify you of upgrade opportunities, contests, promotions, or special events and offers. We also use your e-mail address to send you messages about the Emily Labs and other general announcements. Additionally, personal information you make public will be viewable by other users of the Emily Labs. We keep track of your interactions with us, including but not limited to your activity within the Emily Labs. We may use personal information that you provide to us to send messages to you in response to your request to perform an activity in connection with your use of any of the Emily Labs. We may also use your personal information to contact you when necessary for service issues.
We may use your personal information by making it non-personally identifiable, and then aggregating it with other information that we have collected in a manner such that the end-product does not personally identify you or any other user of the Emily Labs. When we do this, we make your personal information non-personally identifiable by either combining it with information about other users (aggregating your personal information with information about other users without identifying you personally), or by removing characteristics (such as your name or email address) that make the information personally identifiable. This process is known as de-personalizing your information. You grant us a royalty-free, worldwide, perpetual, irrevocable and fully transferable right and license to use your de-personalized information in connection with the creation and development of analytical and statistical analysis tools relating to the use of the customer data we collect in providing the Emily Labs (the “Analytical Data”). We are expressly authorized to make any commercial use of the Analytical Data, including without limitation, sharing the Analytical Data with third parties, provided that we do not sell, trade, or otherwise transfer from us any part of the Analytical Data that personally identifies you in any way.

Our servers automatically record information that your browser sends whenever you visit our Site(s). Additionally, some of the Emily Labs may collect information regarding your computer system. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the Emily Labs, if any, the operating system your computer uses, the type of computer hardware you have (such as the amount of RAM, the type of GPU or type of CPU in your computer) which Emily Labs you use and when and how long you use them. We use this information to monitor and analyze how users use the Emily Labs, to provide customer service and to maintain and improve the Emily Labs.
The Emily Labs are expressly not intended for children under the age of 13. We do not knowingly collect or maintain any personal information or non-personally-identifiable information from anyone under the age of 13 nor is any part of our website, software or service directed to children under the age of 13. We will close any accounts used exclusively by such children and will remove and/or delete any personal information we believe was submitted by any child under the age of 13.
Will we share your personal information with third parties?
Sharing of Information
We may use your personal information to provide analyses of our users in the aggregate (including the Analytical Data) to prospective partners, advertisers and other third parties. We may also disclose and otherwise use, on an anonymous basis, affiliation, position, interests and other non-personal information about customers. We may share your personal information with carefully selected vendors and business partners, including companies that perform marketing services and other business operations for us, under strict terms described herein.
In addition, we will share the personal information we collect from you under the following circumstances:
Protection of rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce the Terms of Service for the Emily Labs, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Emily Labs, or (iv) such action is appropriate to protect the rights, property or safety of Emily, its employees, users of the Emily Labs or others.
Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of Emily’s assets, user information, including personal information collected from you through your use of the Emily Labs, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you, either through email and/or a prominent notice on the Site(s).
Third Party Offers. We may also share your personal information with third party partners when you have opted into receiving third party offers and/or newsletters on our Site(s). We will not disclose your personal information to third parties for marketing purposes when you have not opted into receiving or have opted out of receiving such third party offers and/or newsletters through the Emily Labs. You may request that we stop sharing your information with a third party or third parties for direct marketing purposes after you have opted into such disclosure through the Emily Labs by emailing us at [email protected] and informing us of your desire for us to stop providing your information to a specific third party or a list of specific third parties. Emily’s disclosure to third party partners may be made for cross promotional purposes, but Emily will not receive compensation as the primary consideration for such disclosure.
Additional Information You Should Know About Third Parties
The Emily Labs may also have message boards, forums and/or chat areas, where users can exchange ideas and communicate with one another. When you post to a message board, forum or chat area, please be aware that the information you post is made publicly available on-line and you do so at your own risk.
What choices do you have about the collection and use of your personal information?
Control of Your Information
We may use third-party advertising companies, such as Yahoo!, Google, OpenX and Lijit to serve ads when you visit the Emily Labs. These companies may use information about your interests in order to provide advertisements about goods and services of interest to you. If you would like more information about this practice and to know your choices about not having this information used by these companies, see the Digital Advertising Alliance’s or Network Advertising Initiative’s website.
You may update or delete your personal information or modify your account preferences for the Emily Labs by accessing the “My Account” area of the Emily Labs or sending us an email to [email protected] requesting us to update or delete your personal information. However, information previously shared with other users through a chat room, forum or otherwise may not be deleted. Please note that when you delete your account, we may retain your account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.
Opting Out of Receiving Communications from Us
If you no longer want to receive our newsletter, e-mails or other announcements, you may unsubscribe by selecting “unsubscribe” in your account, writing to us at [email protected] or replying to the unsubscribe link at the bottom of our e-mails. Please note that you cannot unsubscribe from certain service related correspondence from us, including messages relating to your account transactions. If you wish to unsubscribe from any newsletters, offers, e-mails or other announcements from our third party advertising partners that you have opted into through the Emily Labs, you will need to contact such third party advertising partner directly through their independent website(s) or by clicking on the unsubscribe link at the bottom of any such emails (if any).

What security measures do we take to safeguard your personal information?
The personal information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to Emily employees, independent contractors and agents who need to know this information in order to develop, operate and maintain the Emily Labs. All Emily personnel who have access to this information are trained in the maintenance and security of such information. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the Emily Labs and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.
